How To Order

Shipping Policy

Mountain Performance recommends that you do not rush the installation of any of our products. We understand that the snowmobile season is limited and that time is of the essence. HOWEVER, please understand that we offer products that provide radical improvements in performance. You should always allow plenty of time for installation and product delivery. 

In the event that you must disregard our advice and expedite an order utilizing Air Freight or other means of expedited delivery, Mountain Performance WILL NOT be held responsible for any kind of delay or costs involved. Potential delays include, but are not limited to Freight Damage, Freight Delays, Incorrect product, DOA (Dead on Arrival) Parts, or Missing Product. Expedited orders are given special attention and every attempt is made to ship same day. This type of exception based order processing can lead to errors. Mountain Performance may, at its own discretion, pay GROUND freight (never air freight) to remedy an error. Expedited freight charges for additional or replacement parts for any reason are always the customer’s responsibility. PLEASE consider these facts before selecting Air Freight or other means of expedited delivery.   

Basically – What this means is if we screw up your order or the shipping company screws up we will NOT be overnighting yours parts to meet a deadline.

Most orders are shipped the same day or the next day for all in stock items. Most items are in stock. All orders are shipped UPS (Ground, 3 Day Select, 2nd Day Air, Next Day Air Saver, or Next Day Air) or Truck freight on larger items. Truck fright must be delivered to a commercial address. Shipping Cutoff for orders is 2:30PM. No order may be shipped after that time and will typically be shipped the next business day. All shipping and handling charges are non-refundable. No Exceptions. Any orders that include a mix of in stock and backordered items will be shipped partial (additional freight charges will apply on partial orders). A request for complete shipment may be made. We ship worldwide. Please call us for freight rates. The total shipping charges are calculated based on the shipping zip code your order be shipped to, the size, and the total weight of all the items in your order. Shipment of all products shall be shipped from Mountain Performance, Inc., unless otherwise indicated. In the event of damage, delay, or loss due to the mishandling in transportation, purchaser shall deal directly with the common freight carrier. Purchaser shall instruct Mountain Performance with shipping instructions. If no specific instructions are given, Mountain Performance will select the most reasonable shipping method to ensure the on time delivery, with reasonable freight cost. Mountain Performance, Inc. is not liable for delay or any freight charge of shipment due to the absence of shipping instruction from purchaser.      

A restocking fee of 20% or $20(whichever is larger) in addition to the Shipping and handling charges will be applied to any package(s) refused at the time of delivery as it is considered a return.

Methods of Payment    

Payment can be made by Visa, MasterCard, Cashiers Check or Money Order. Please do not send cash.

If you are using a credit card as your form of payment, you must use the address where your credit card statements are sent or the shipping address must be verified with the credit card issuer. If for any reason the information you provide for credit card payment is incorrect, we will contact you using the phone number provided and notify you of the situation. If we are not able to contact you within 72 hours or the phone number is invalid, the order will be deleted. Mountain Performance, Inc. will never provide a cash refund to the customer on a credit card order.

Back Orders

Although we make every effort to ship your product the same day, sometimes an item will be in short supply. Should this occur, we will notify you either by e-mail or phone that your product cannot be shipped in a timely manner. We will do our best to expedite your order and/or provide you with and estimated time of delivery. No charges will be made to your credit card until the product is shipped (special orders excluded).

Refused Shipments

If you order merchandise, change your mind, and refuse the package, Mountain Performance, Inc. will charge a 20% (or $20 which ever is more) restocking fee plus freight (both ways). These charges are the purchaser’s responsibility. Please refer to the Mountain Performance "Return Policy" for returning items.

Return and Cancellation Policy

Mountain Performance offers you a 15-day return period from the date of shipment; SPECIAL ORDER ITEMS EXCLUDED. Warranty registered items, such as superchargers may not be returned if warranty registered or have been oiled, installed or similar. A restocking fee of 20% may apply (at MPI's sole discretion). Contact our Sales Department to process a return. Do not return an item without receiving an RA number from MPI.  We specify that the product has not been installed or damaged, does not have missing components, and that the manufacturer's documentation is intact and must be in the original packaging. We will not accept C.O.D. packages. Products, which are not in like new condition, will be charged a restocking fee at the discretion of our company. Credit will be issued for the products only. Shipping charges will not be refunded. Should your order arrive damaged, contact your local UPS office or appropriate delivery company within 48 hours of delivery for a claim replacement to be accepted. If you experience a problem with the freight company handling your claim, please contact our sales office for assistance. There will be a 1.5% finance charge per month on all past due invoices and a $20 service charge per returned check. Customer hereby agrees to pay all collection costs including attorney’s fees and court costs if such are required. In all cases labor is non-returnable and non-refundable.

Special orders are non refundable.

When a refund is applicable, credit card purchases will result in the return credit being applied to the same card used for the original purchase. A Mountain Performance, Inc. check will be issued for refunds to sales where the original payment was made by check or money order.

Warranties

Warranty on products and parts produced by Mountain Performance, Inc. varies. Please contact MPI for warranty coverage on a particular item. Most items are covered by a one-year material/workmanship guarantee. Mountain Performance, Inc. assumes no responsibility for the use, misuse or application by the user. Mountain Performance will not be held liable for injuries incurred as a result of any of its products or other parts these products may affect.

Mountain Performance, Inc. warranties defects in materials or workmanship of all parts and service sold, but provides no warranty, whether oral, written, express or implied, except as follows:

The warranty (if any exists) of any item purchased from Mountain Performance, Inc., begins on the original invoice date, and the returned items must be received by our Returns Department 15 days before warranty expires. The warranty for items not manufactured by Mountain Performance, Inc. is determined by the manufacturer of each product. The warranty period will be based on original purchase date, with exceptions as listed herein, described in the manufacturer's documentation included with the product or on the invoice. If the replacement part is in stock, Mountain Performance will replace the part with a new part. If the replacement part is not in stock, Mountain Performance will send the warranted part to the manufacturer for repair, exchange, or credit at no charge, but makes no representation or warranty beyond the manufacturer's warranty. Mountain Performance provides absolutely no warranty, and accepts no return or upgrade, for any returned items without the original invoice. This warranty is void at Mountain Performance’s discretion on any products that are abused, mishandled, or altered.

Damaged Merchandise

Before we ship, products are inspected for damage and repacked to make sure they arrive at your door safely. Claims for damage during shipment must be made by you to the delivering carrier within 48 hours of receipt. Also notify us of the problem and we will make arrangements to replace the damaged item.

Legal Disclaimer

Seller hereby expressly disclaims all warranties either expressed or implied warranty of merchantability or fitness for a particular purpose. This disclaimer by the seller in no way affects the terms of the manufacturer’s warranty, if any. Title to goods herein being purchased is retained by the seller until goods are paid for by the purchaser and at that time title passes to the purchaser. If goods herein being purchased are being purchased for purposes of export, purchaser must obtain from the federal government certain export documentation before shipping to a foreign country. In addition, manufacturers’ warranties for exported goods may vary or even be null and void. If you have questions, please inquire. Any and all liability is only for the products purchased.

Scope of this Agreement:

This agreement covers all materials in which the customer may hereafter acquire at any time from the supplier. This contract constitutes the entire agreement with the supplier. No waivers or modifications shall be valid unless the same are in writing and executed by the parties thereto. This contract shall apply and accrue to the benefit of -- and be binding upon -- the heirs, executors, administrators, successors, and assigns of the respective parties.

Litigation:

In the event of litigation arising out of either this agreement or any consumer-purchase at Mountain Performance, Inc., Mountain Performance shall be entitled to reasonable costs and expenses incurred pursuant to the aforementioned litigation including, but not limited to, attorney’s fees.

Forum Selection Clause:

All litigation, disputes, conflict of laws, and etcetera, arising out of any purchase transaction with Mountain Performance, Inc. shall be governed by the laws of the State of Utah and shall be litigated within the forum of the State of Utah.

Receipt and Acceptance of Agreement:

Acceptance of goods from Mountain Performance, Inc. manifests the customer’s acknowledgment of receipt and acceptance of this agreement and its execution at time of purchase.

Credit Cards  by 
We accept credit cards as a form of payment. There is no surcharge for using your credit card to make purchases. Please be sure to provide your exact billing address and telephone number (i.e. the address and phone number your credit card bank has on file for you). Incorrect information will cause a delay in processing your order.

Multiple Product Orders  by 
For multiple product orders, we will make every attempt to ship all items contained in that order at the same time. Products that are unavailable at the time of shipping will be shipped as they become available, unless you inform us otherwise. You will only be charged for products contained in a given shipment, plus any applicable shipping charges. You will only be charged for shipping at the rate quoted to you on your purchase receipt. The entirety of this shipping charge will be applied to the first product(s) shipped on a multiple shipment order.

Order Acceptance Policy  by 
Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. Mountain Performance, Inc. reserves the right at any time after receipt of your order to accept or decline your order for any reason or to supply less than the quantity you ordered of any item.

Out-of-Stock Products  by 
We will ship your product as it becomes available. Usually, products ship by the next business day. However, there may be times when the product you have ordered is out-of-stock, which will delay fulfilling your order. We will keep you informed of any products that you have ordered that are out-of-stock and unavailable for immediate shipment. You may cancel your order at any time prior to shipping.

Typographical Errors  by 
In the event a product is listed at an incorrect price due to typographical error or error in pricing information received from our suppliers, Mountain Performance, Inc. shall have the right to refuse or cancel any orders placed for products listed at the incorrect price. Mountain Performance, Inc. shall also have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, Mountain Performance, Inc. will issue a refund to your card in the amount of the incorrect price
